62 year old woman charged with a 3rd DWI and a refusal as well as other moving violations here in Brick Township. She was traveling east at the Wawa gas station and collided with the safety pillar next to the attendant's shelter. She was charged with DWI (a third), reckless driving, open containers in vehicle, careless driving, leaving the scene of an accident, and failure to report an accident.
She was also charged with refusal to submit to a breath test even though there was a breath test result of 0.212%. The charges against my client arose on 2 different dates. On the first date, the state actually dismissed 7 charges. On the second date, the state dismissed 6 charges including a 3rd DWI. We were able to get all charges dismissed except for the refusal charge which saved her 6 months in jail. She will be doing no jail time.
The client has been charged with possession of marijuana, and possession of a controlled dangerous substance in a motor vehicle which carries with it a 2-year loss of license.
We made a motion for the State to produce lab results within 60 days. If the state fails to produce lab results, the court is likely to dismiss the criminal possession of marijuana charge and we believe in any event that the possession of CDS in a motor vehicle will also be dismissed. Pending.
